    Doctor convicted in Jackson death seeks release

    LOS ANGELES (AP) — The doctor convicted of involuntary manslaughter in Michael Jackson's death asked a judge Friday to release him from jail pending his appeal.

    Dr. Conrad Murray, who is serving a four-year jail sentence, said in a declaration that he should be released either on his own recognizance or on bail with electronic monitoring.

    He said he is not a danger to society, will not flee the area, and wants to work to help support his seven children.

    His lawyer, J. Michael Flanagan, said in the motion that Murray knows he cannot work as a doctor but would find other employment. He suggested the sentence and Murray's mode of confinement is extremely severe for a man with no prior criminal record.

    He said Murray is being held in solitary confinement and is chained to a table when he meets with his lawyers. He also said Murray is extremely sorrowful about Jackson's death.

    Jackson died in June 2009 from an overdose of the anesthetic propofol, administered by Murray. Flanagan conceded that Murray made some medical misjudgments but said he never intended harm to Jackson.

    Murray's appeal has not yet been filed, but the motion offered a preview of some issues that will be raised, including the claim that Superior Court Judge Michael Pastor should have allowed testimony about Jackson's financial condition.

    Flanagan said the exclusion of that evidence "seriously compromised the defendant's ability to demonstrate the desperate situation which was guiding the decisions and choices of both Mr. Jackson and Dr. Murray."

    Murray appeared to be blaming Jackson for decisions that led to his death.

    "Mr. Jackson was an uncooperative patient who made decisions and demands based upon his particular needs," said Flanagan. "One of which was his extremely precarious financial situation complicated by drug addiction. "

    Flanagan also cited the judge's refusal to sequester the jury and the presence of cameras in the courtroom as appellate issues.

    With Murray's appeal expected to take more than a year to move through the courts, the attorney said it would be unfair to keep him jailed in the interim.

    Under sentencing guidelines, Murray is expected to serve no more than half of his sentence. The attorney said if he served his complete sentence he would not receive the benefits of a favorable appeal decision if his case was overturned.

    A hearing on the motion was set for Feb. 24.

        i can see mj part in his death.. A) jesus juice ( wine in a pepsi can.. B) had drug issues in the past grant the doctors gave it to him. maybe many with fake names... C) all that combined did a number on his health.. D) plastic surgery did not help either... add this last one i think mj knew it would be a nail in the coffin for him.. if someone said um not a good idea boy- he would find another dr to bribe with $$$$$ to do it. i see andy gibbs part ion his death, heath ledger, the one corey, etc.. loved mjs music. just not the man... he was a talented guy and i said when i heard celine dion sing his music it was wrong. NO ONE can do justice to his stuff.. not his brothers, sister, nephews, nieces, kid or his bil/ sil..

        the last trial he had i kinda knew he was gonna be gone in a few years.. he had drug issues long before this guy.. molested kids, paid the, off to go away... i know i am gonna hear oh no he was so great... hell his parents were complete idiots... mama allowed joe to cheat and beat her and the kids.. she should have left years ago when the kids were little..

      OHHHH so NOW he needs to work so he can PAY his child support ~ have you all forgotten that he was many thousands of $$$ BEHIND on his Child Support~!? He knew he was NOT to administer Proprol in any environment but a hospital. He has a Degree in Medicine, Cardio Vascular Surgeon - HE KNEW, YET, a little $$$, and a life of comfort, was enough to cause him to commit the crime of administering it out of the hospital environment AND without BACK UP. This is not some dumb witch doctor pretending to know medicine - he actually has/(had) the Degree but not the morals to accompany it. A son, brother, father, etc., died due to his lack of morals so let him sit and STEW, learn to be HUMBLE and think about what he should have done from the beginning. He needs to be in the general population to see how prison life REALLY goes.

      This guy to this day says he did nothing wrong, which in and of it self tells me that he indeed is a danger to society. If he was out he is dumb enough to see patients and maybe even help someone out with insomnia again, for money, hell yes, he would. MJ's kids never get him back. They never get to go visit their dad in jail, like Murray's kids can. Maybe Murray should of thought about his kids when he was parading all these so called mistresses through the courtroom. Maybe he could take a CPR class while in jail. What makes him think that he will get an appeal? He still didn't call 911 like he should have and he administered the propofol and walked away and then didn't even know how to do CPR, come on, why would the outcome be different? 3 years is not a long time, he should man up and serve his time.
